• Communications: Records of correspondence, inquiries, and feedback you send to us
• Client Portal Emails: When our team emails you a link to your Client Portal, we keep a record of that email with your project: the email addresses and first name it was sent to, the Curate team member who sent it and their reply-to address, the subject and message, which page of the portal it opens, the time it was sent, and whether and when its link was opened. The link in the email is private to your project and opens your portal without an Access Name, so please do not forward it. We can switch a link off at any time, which also signs out anyone using it. These details are never included in our usage analytics or session replays.
• Job Applications: When you apply for a role on our Careers page, the name, email address, phone number, city, years of experience, profile link, project details and message you enter, and any resume you attach. We use them only to consider you for that role and other openings, and to contact you about your application. They are emailed to our hiring team and stored with restricted access. They are never used for marketing, never added to our customer contact or sales systems, and never included in our usage analytics or session replays.
• Quote and Proposal Acceptance Records: When you accept and sign a quote or proposal in our Client Portal, the name and email address you enter, your typed or drawn signature, the date and time, the quote or proposal you accepted and its amount, the acceptance wording you agreed to, and the IP address and browser details sent by your device. These details are added to a signed copy of that document that you and authorized Curate team members can download. They are never included in our usage analytics or session replays.

Information Collected Automatically

When you visit our Site, we may automatically collect certain technical information, including:

• Device Information: IP address, browser type and version, operating system, and device identifiers
• Usage Data: Pages viewed, time spent on pages, referring URLs, click patterns, and navigation paths
• Location Data: General geographic location derived from your IP address

• Legal Requirements: When required by law, court order, or governmental authority, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others
• Business Transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction
• With Your Consent: When you have given us explicit permission to share your information for a specific purpose

4. Data Security

We implement reasonable administrative, technical, and physical security measures designed to protect your personal information from unauthorized access, disclosure, alteration, or destruction. For construction project data, we typically retain records for a minimum of seven (7) years following project completion to comply with applicable statutes of limitations, warranty obligations, and industry record-keeping standards.

Signed quotes and proposals and their acceptance records, and records of Client Portal emails we send you, are part of your project records and are kept on the same basis.

Job applications and resumes are kept for as long as we need them to consider you for open roles and to meet employment record-keeping requirements. You can ask us to delete your application at any time using the contact details in Section 10.

When personal information is no longer needed, we will securely delete or anonymize it in accordance with our data retention policies.

6. Cookies and Tracking Technologies

Our Site uses cookies and similar tracking technologies to enhance your browsing experience and collect usage information. Cookies are small data files stored on your device that help us understand how visitors interact with our Site.

Types of cookies we use:

First-party usage analytics and session replay

We run our own analytics on this Site and on our Client Portal to understand which pages and project materials are useful and where visitors run into trouble. This analytics is operated by Curate Construction and is not shared with third-party analytics or advertising providers. It records the pages and screens you view, time you actively spend on them, how far you scroll, where you click or tap, general pointer movement, the type of device and browser you use, and how you arrived at the Site (for example, an advertising campaign). On the Client Portal it also records which project materials are opened, which pages of a document are viewed, video playback progress, and attempts to save or print materials.

We may also record a privacy-masked replay of a visit that shows how pages were navigated. Anything you type into a form field is never recorded. On the Client Portal, project text, documents, images, and videos are hidden in replays. Replays are available only to authorized Curate team members.

This analytics does not store your IP address. It is used only briefly, in one-way coded form, to block automated abuse, and visits are stored under one-way coded identifiers. If your browser sends a Global Privacy Control signal, we do not record replays of your visit and do not link your separate visits together. Replays are deleted automatically after 90 days, and other usage analytics records are deleted after 24 months.

7. Your Privacy Rights

Texas Residents (TDPSA)

Under the Texas Data Privacy and Security Act, Texas residents have the right to:

• Confirm whether we are processing your personal data and access that data
• Correct inaccuracies in your personal data
• Delete personal data you have provided to us
• Obtain a portable copy of your personal data
• Opt out of the processing of personal data for targeted advertising, sale of personal data, or profiling

California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, including:

If you choose to opt in to text messaging, Curate Construction may use your mobile number to send only the categories of messages you selected. Service texts and marketing texts are consented to separately, each with its own checkbox, and we record each consent with its own date and time. Consent is optional and is not a condition of purchasing services. You may opt out at any time by replying STOP or request assistance by replying HELP.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
